Unfair Credit Card Charges FAQ

If you think you’ve paid unfair credit card charges then you can claim them back through BankCharges.com, take a look at this FAQ for answers to some common questions related to claiming…

How Much Does A Claim Cost?

There are a few costs you’ll need to consider when making a claim, first you’ll need to get hold of the last 6 years statements if you don’t already have them. This is done through your lender can cost up to £10, you’ll need to write to your lender to request the statements, so find out the cost and pop a cheque in with the letter to speed up the process.

If the charge is more than you wish to pay, you can submit a Data Protection Act (DPA) disclosure request. This will be less but bear in mind that the DPA route can delay a claim by up to 40 days. Remember: if you have online banking, you may be able to access all your statements for free.

Another cost to be considered is that of calls to your card provider regarding your statements, think the worst and be prepared for 0845 and 0870 number tariffs. Remember: make a note of any communication you have with your lender and what is discussed, be sure to mark on a calendar when you post letters as this information could be useful for your claim.

What If My Lender Doesn’t Cooperate?

- If we handle your claim, we’ll take care of all contact with your lender, we’ll work out how much you’re owed and send your card provider the claim amount. Once they have it, they usually respond in one of two ways:

- Refuse to payout on the claim.
- Offer a full or part settlement.

If your card provider doesn’t respond, refuses to payout or offers an uncceptable settlement figure, we’ll make sure they are answerable. Of course, if you’re happy with the settlement figure, the claim will end here.

Will The Claim Go To Court?

In our experience, if the claim is for a small amount, the card-provider will often settle quickly to avoid legal and admin costs that would outway the payout. However, if the claim is large, it is frequently the case that the lender will do nothing and hope that you don’t take it to court. If the claim goes to court, there are fees involved which can be claimed back from your lender, if you claim through BankCharges.com, we’ll deal with these costs.

Once the case goes to court, if your lender doesn’t turn up doesn’t defend itself, it must pay the full amount of your claim as well as refund your court fees. Must I Have All My Statements?

You don’t have to have all your statements but it will help your claim if you do and will also mean your settlement figure could be higher. You should try to get hold of the past 6 years in statements, Remember: if you don’t have every copy then you can request them from your card provider or if you have online banking they may be available there.

Once you have as many statements as possible, take the following action:

- Highlight all the penalty charges.
- Add them all up.
- If you’re using BankCharges.com, give us a call on 0800 840 7291 and we’ll start your claim.

What If My Statements Go Back Further Than Six Years?

Lenders must keep records of the last 6 years transactions for a customer account, if your card was taken out over 6 years ago you may not be able to get hold of all the produced statements. If you find yourself in this situation you can submit an estimated claim. To build an estimated claim, you calculate charges from available statements and then multiply the amount to cover the entire time of card agreement.
